If you wish to clarify any item in these Terms & Conditions, please email sales@taywell.co.uk. We may choose to update these Terms & Conditions from time to time but any changes will be posted on the site. Please note that these Terms & Conditions do not affect your statutory rights as a customer.
Privacy Policy
By providing your details to us on the site at time of ordering, you consent to us maintaining, holding and using such details for the purposes of processing your orders. We collect and maintain all data in accordance with the requirements of The Data Protection Act 1998.Your personal details will only be passed to other companies who are by necessity involved in processing and fulfilling your orders and will not be passed to any other third party for any reason.
Prices
The prices payable for goods that you order are clearly set out in the site. Should we have inadvertently, incorrectly priced an item on the site, we will not be liable to supply the item at the stated price, prior to our acceptance of your order. All prices are expressed inclusive of VAT.
Availability & Unforeseen Circumstances
We will notify you as soon as possible if for any reason we are unable to supply a particular item. In these circumstances you have the right to modify or cancel your order. Under these circumstances you will receive a full refund.
Delivery
There is no delivery charge but there is a minimum order quantity of 3 x 2.5lt tubs and currently, we are only able to deliver to TN, ME, BR, CT, DA, RH post codes through this e-commerce site. For all other areas in Kent, please contact the office for our ability to fulfil your order in other Kent, Surrey or south London post codes.
Delivery will be made to the delivery address given by you on the on-line order form. We use our own vans for delivering and you can expect delivery within two working days or later, if required. We will not however, be liable for loss occasioned by delay arising from any cause outside our reasonable control.
All goods should be signed for by an adult aged 18 years or over and if no one of that age is available when delivery is attempted, the driver may leave a notification of attempted delivery and will retain the goods for future delivery.
You agree to inspect your consignment upon delivery and to notify us by email to sales@taywell.co.uk within 3 working days should items be damaged or of incorrect type or quantity. You must retain the defective goods for our collection and inspection. We will then endeavour to rectify problems and to replace items or refund as appropriate. If it is obvious that the consignment is incorrect or has been damaged, you should inform the driver immediately and refuse the goods. If you do not receive goods ordered by you, you must notify us by phone and in writing within 14 days of the date on which you ordered them, otherwise we shall have no liability to you.
Cancellation
Under the Consumer Protection (Distance Selling) Regulations 2000 (SI 2334/2000), you have the right to cancel your order after receipt of goods. Under these regulations you have the right to return goods purchased from this site for a full refund subject to the following conditions:
You must inform us by phone (01580 212813) Fax (01580 213620) or e-mail (sales@taywell.co.uk) within 7 days of receiving the goods of your intention to return them.
The goods must be returned in their original packaging, unused and in undamaged stock condition, suitable for re-sale. The goods must be returned within 7 days of receipt. If you do not make the goods available for collection by us within 7 days of your cancellation, we will make a charge in respect of the recovery of the goods. If you do not make the goods available for collection by us within 7 days of your notice of cancellation, you will be deemed to have accepted the goods; at which point, a new contract will exist between you and us and if necessary, your credit or debit card will be re-charged with the price of the goods.
Payment
You can pay by credit or debit card though our secure payment system. It will be taken that your authority for payment has been given when you complete the order form. Your payment will be debited from your card account before the goods are dispatched to you. Our total liability to you will not exceed the total price of the relevant items.
Retention of Title & Risk
The goods shall remain the property of Taywell Ice Creams Ltd until you have paid for them in full.
Liability
Unless otherwise specified the materials published on the site are presented solely for your personal and non-commercial use.
This Site is controlled and operated by the owners of Taywell Ice Creams Ltd (www.taywell.co.uk).
The customer (you) will assume total responsibility and risk for use of the site and any information contained within it. Taywell Ice Creams Ltd is not responsible and is not be liable for any losses incurred due to use of any statements, recommendations, advice and opinions expressed on this site. These are made in good faith on the basis of information available to us at the time.
